Terms of Service
This agreement is between I, the Artist, and you, the Client, for work services performed on a project known as the Work.
Content
I, the Artist, have the right to refuse projects and requests according to my discernment and capabilities. Some content that I will not be comfortable with representing includes:— Heavy gore or excessive violence
— Loli or underage
— Fully mech
— Furry
— Offensive / political imagery
— Copying others' stylesBefore I can start working on a commission, I will need any kind of reference material. I can work with different images, whether drawn or photo material, picrews, pinterest inspiration boards. Written descriptions are acceptable too, as long as they are concise and to the point. Material and design direction such as mood boards and examples are referred to as inspiration, not reference, and will not be closely observed.
Process
— Once I review the information from the Submission Form, I will get back to you with a quote and to sort out additional details (if any). I'll send you an invoice requesting a 50% deposit as the minimum payment amount before I start work on the commission.Wait for updates
— Approximate time to complete a commission is 4-6 weeks depending on complexity and communication process.— Updates will be sent every 7-10 days or at the end of every phase (e.g. sketch, flat colors, render). Once I send an update, work on the artwork will be paused until I get a response - either edit requests or approval. If needed, feel free to draw over any material I send during these check-ups to better illustrate your ideas.— 3 moderate revisions that do not require a redraw of more than 50% of the image can be done for free. Anything more than that (or revisions that require significant rework) will cost an additional fee.Final sign-off
— When the artwork is finalized, I will request the remaining 50% of the sum. Changes at this stage will also incur a fee.— Once the payment is complete, I will provide you with the final non-watermarked, high resolution file.
Usage & Rights
Artist Rights
I retain original copyright and ownership of the Work, which includes but may not be limited to redistributing, reproducing, advertising. I have rights to repurpose unused process work for future projects, personal or otherwise.I retain the rights to display the Work in my websites, social media and portfolios according to my discretion (Twitter, Instagram, Tiktok, etc.), unless Clients request otherwise before project begins. A NDA or confidential commission status may be subject to a +25% fee.Client Rights
The Client may use the artwork for personal items such as: Social media profile pictures, signatures, layouts, themes, wallpapers, personal website display, social media posts, private prints, merch for personal usage or gifts for friends, as well as to post the finished product on their personal social media accounts with credit.Any Work done or made available to the client must not be used for AI, Machine Learning, AI/ML Training, NFT, blockchain or any for profit platforms or purposes. Such usage is completely prohibited and may result in legal action taken.The Client may not at any time modify, edit, change the Work without permission from the Artist. Additionally, should the Client decide to change or adjust the commission works through the use of machine learning or derived technologies, I will consider this an automatic purchase of exclusive rights and charge the standard fee per artwork. Please inquire about the exact fee for your commission in advance.Commercial Rights
Unless specified in the commission information or otherwise discussed and agreed upon, commercial licenses and reselling rights are not included. Commercial means usage on any monetized work (i.e. including but not exclusive to: merchandise, monetized videos, music releases); and reselling rights means selling the Work to another party or another platform or on any platform.
Pricing
All starting prices listed are for personal commissions only. The rates can change depending on complexity, details, and characters in an illustration. The Client and the Artist agree on a price before the invoice is sent.Commercial Rights require a contract and a discussion of price beforehand. The rates will differ. Please contact me to arrange in more detail.Patrons are entitled to a 10% discount on all prices.
Payment
Payments are made via PayPal or Wise/bank transfer. 50% is required upfront, and the rest upon completion of the commission, unless arranged otherwise.Final watermark-free files will be supplied after the full payment has been made.
Cancellation
The Artist reserves the right to terminate the commission process and issue a refund if The Artist is unable to continue work on it for whatever reason, or as a result of poor communication and rude or inappropriate behavior.The Client may suspend the commission at any point during the process. The initial deposit can be refunded only if the sketch phase of the commission has not been started. Finished illustrations will not be refunded.
Agreement
The Client must read, understand and agree to all these terms before entering an agreement with The Artist. Upon payment, The Client is agreeing to the aforementioned terms.By commissioning, you confirm you are at least 18 and above or have a legal parent/guardian to agree to all of the terms of service as listed above.The date for this agreement is upon the first inquiry/communication for the commission or upon the first transaction made.
